The legal profession is exercised in compliance with the Act of December 31, 1971, the decree of November 27, 1991 organizing the legal profession, the decree July 12, 2005, on rules of conduct for lawyers and harmonized rules.

Since 1 January 1992, occupations of legal advice and lawyers have merged and there is a single for the legal profession and the judiciary: the legal profession.

The legal profession includes among its members all types of structure and mode of exercise: individual firms, large firms, lawyers and staff lawyers.

Consequently, legal advice, drafting of documents and representation before the courts are regulated activities.

It should be noted that a decree of February 18, 2009 amends the regulation of the legal profession and relates to the profession, transposing EU directives.

Article 3 of the Act of December 31, 1971, as amended by the Act of June 15, 1982, provides that attorneys take oath in these terms:

"I swear, as a lawyer, to perform my duties with dignity, conscience, independence, integrity and humanity"

Article 3 of Decree of July 12, 2005, on rules of conduct for lawyers provides:

"The lawyer performs his duties with dignity, conscience, independence, prohibitions and humanity, in compliance with the terms of his oath. It also honors in this year, the principles of honor, loyalty, unselfishness, brotherhood, discretion, moderation and courtesy. He demonstrated against his clients, expertise, dedication, diligence and prudence. "

Entry to the Bar of Toulon requires compliance with ethical rules, contained in the harmonized rules. The breach of fundamental principles can lead to sanctions ranging from reprimand to removal from the bar.

The lawyer must comply:

* The rights of defense and contradictory;

* The complete disclosure of the factual and legal under the rules of procedures;

* Confidentiality.

The lawyer must, in its dealings with its customers to keep absolute secrecy.

The lawyers must ensure that confidentiality is respected trade.

Communications and exchanges between counsel are confidential in nature.

Consequently, the lawyer commits any material, no disclosure contrary to professional secrecy.
